Terms
These terms are an agreement between you and Liam Dowsett-Clark, a sole trader trading as BAL Buddy (ABN 51 645 838 661 Current details Historical details) ("we", "us"). By using BAL Buddy you agree to them. Questions: email clarkliam86@gmail.com.
1. About BAL Buddy
BAL Buddy gives an indicative Bushfire Attack Level (BAL) by applying Method 1 of AS 3959:2018 to the site, building and vegetation you enter, with slope worked out from public elevation data.
BAL Buddy gives an indicative Bushfire Attack Level (BAL) only. It isn't a determination under any Act, and no council or building surveyor has to accept it. For a BAL you can rely on, use an accredited bushfire practitioner.
- The result is only as good as what you draw and choose, and the mapping and elevation data it uses. Check them on site.
- It doesn't do Method 2, and it can't give a BAL where the ground falls away more than 20° under the vegetation.
- A BAL determines which construction requirements apply to the building. Your building surveyor or an accredited bushfire practitioner can tell you what they are.
- BAL Buddy doesn't check whether a site is in a mapped bushfire-prone area. Confirm that with your council or building surveyor.
2. Accounts
Keep your sign-in to yourself; you're responsible for what's done with your account. Use a real email address you can receive mail at.
3. Runs, free runs and what you see before Complete
- You can do every step without an account. A result needs a run. One free run without an account, per network and per browser, every 30 days; that result shows on screen only.
- One more free run when you create an account with a verified, permanent email address (not a temporary or disposable one), once per email address whatever way you sign in.
- We may hold free runs for review if many accounts claim them from one network. Paying always works.
- Signed in with a run available, you see distances and slopes as you go, for up to 25 different sites in any 24 hours; after that, and for guests, they show after Complete. The BAL always shows after Complete.
- Changing a completed run is free for 30 days, while the building stays within 50 m of where it was.
4. Paying
- Prices are in Australian dollars: $39 for one run; or $149 for a pack of 5 runs ($29.80 a run; the pack runs don't expire); or $199 a month for the Pro plan, which includes up to 100 assessments a month.
- BAL Buddy is not registered for GST, so no GST is charged.
- Stripe takes payment. A run unlocks once Stripe confirms it.
- The monthly plan renews each month until you cancel. Cancel any time from your account (Account options); it stays active to the end of the month you've paid for. Deleting your account cancels the plan straight away.
- Access codes are worth what they say, can be used once per account, and may expire. We can cancel a code that's being misused.
5. Refunds
We don't give refunds if you simply change your mind, for example after seeing a result.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. Our services come with guarantees that can't be excluded under that law: if there's a major failure, you're entitled to cancel and to a refund for the unused portion, or to compensation for the drop in value; and if there's a failure that isn't major, you're entitled to have it fixed within a reasonable time. If you were charged twice, or charged for something you didn't get, email clarkliam86@gmail.com and we'll put it right.
6. Using BAL Buddy fairly
You must not bypass the free-run or preview limits, share or resell access, scrape or copy the site or its results in bulk, interfere with its operation, or use it unlawfully. We may suspend an account that does.
7. Your content and ours
What you enter stays yours; you let us store and process it to run the service, as set out in the Privacy Policy. The BAL Buddy software, design and text are ours. Map imagery, elevation and mapping data belong to their providers and are used under their terms, credited on the Data sources page in the app.
8. Liability
To the extent the law allows, and apart from the guarantees in section 5 that can't be excluded:
- we don't promise that a result will match a BAL determined by an accredited practitioner, a council or a building surveyor;
- we aren't liable for loss that comes from relying on a result for planning, design, building, insurance or any other decision; and
- where we can limit our liability for a failure to meet a consumer guarantee, it's limited to supplying the service again or paying the cost of having it supplied again.
9. The service
BAL Buddy relies on outside services (maps and elevation) that can be slow or unavailable, and we may change features over time. If we stop offering BAL Buddy, we'll give you notice and a way to export your runs, and refund unused pack runs.
While BAL Buddy is in beta, saved runs may be reset before launch. Export anything you want to keep.
10. Changes and law
We may update these terms and will change the date at the top. The version in force when you pay applies to that payment. These terms are governed by the law of Victoria, Australia, and the courts of Victoria have jurisdiction.
